2008 CAP Legislative Agenda

  1. Partial-Birth Abortion Ban (HB 2769/ SB 1099- Representative Andy Tobin/ Senator Linda Gray): Places a ban on partial-birth abortion in Arizona statute. The language mirrors the federal law, upheld by the U.S. Supreme Court in April 2007.

  2. Parental Consent for Abortion (HB 2263/ SB 1102- Representative Warde Nichols/ Senator Linda Gray): Codifies in statute an appellate court opinion’s guidelines for court orders authorizing abortions for minors. Responds to Gov. Napolitano’s 2006 veto message of same bill by changing the bill to meet the Governor’s objections.

  3. Abstinence Until Marriage Education Funding (Budget Issue): Maintains funding of $1.5 million in the Department of Health Services budget for abstinence education.

  4. Abortion Alternatives Funding (Budget Issue): Maintains funding of $500,000 in the Department of Health Services budget to provide $20,000 grants to organizations that provide alternatives to abortion.

  5. Jesse’s Law: Based on real life experience of Jesse Ramirez, clarifies the circumstances in which food and fluid may be removed from patients who are unable to communicate with their doctors.

  6. Corporate Tax Credit Built-In Repeal (HB 2098- Representative Steve Yarbrough): Removes the current provision that ends this program in 2011. Program provides scholarships to students to attend the private school as chosen by their parents.

  7. Payroll Deduction for Scholarship Contributions (HB 2100- Representative Steve Yarbrough): Allows employers the option of offering payroll deductions to make it easier for employees to contribute to both the school tuition organization and public school tax credit programs.

  8. Scholarship Tax Credit Contribution Date (HB 2101- Representative Steve Yarbrough): Changes the contribution deadline for the school tuition organization and public school tax credits from December 31 to April 15.

  9. Age Misrepresentation on the Internet (HB 2129- Representative Bob Robson): Makes it a felony for a person to misrepresent their age on the Internet for the purpose of luring a minor.

  10. Record-Keeping for Internet Service Providers (HB 2498-Representative Bob Robson): Requires Internet service providers to keep records for two years for law enforcement purposes.

  11. Students’ Religious Liberties Act (HB 2713- Representative Doug Clark): Enumerates the constitutional rights that students in public schools have to express religious viewpoints in class, in academic work, and through clothing or jewelry.

  12. Charitable Tax Credit Simplification (HB 2693- Representative Steve Yarbrough): Simplifies the charitable tax credit requirements for donations to organizations assisting the working poor.
